Terms of Service

1. Eligibility

• You must be at least 18 years old or the age of majority in your state of residence to use our Site and place orders.
• By using our Site, you represent and warrant that you have the legal capacity to enter into these Terms.
• Our services are available only to residents of the United States (including Alaska and Hawaii). We do not ship to international locations or U.S. territories.

2. Order Placement & Acceptance

• Order Submission: When you place an order through our Site, you are making a binding offer to purchase the selected products. All orders are subject to our availability and acceptance.
• Order Confirmation: A confirmation email does not constitute order acceptance. We reserve the right to reject or cancel any order for any reason, including but not limited to: product stock shortages, errors in product pricing or descriptions, or suspected fraudulent activity.
• Pricing & Taxes: All product prices are listed in U.S. Dollars (USD). State and local sales taxes will be calculated and added at checkout based on your shipping address, in compliance with U.S. tax laws. Shipping fees apply to orders under $15 USD, as outlined in our Shipping Policy.

3. Payment Terms

• We accept PayPal as the sole payment method. Two payment options are available: Add to Cart + Checkout with PayPal or Direct Pay with PayPal (see our Payment Policy for detailed processes).
• Payment must be authorized at the time of order placement. We reserve the right to cancel orders if payment is declined, delayed, or deemed fraudulent by PayPal or our security systems.
• We do not store any of your PayPal account details or financial information on our servers. All payment transactions are processed securely through PayPal’s encrypted gateway.

4. Shipping & Delivery

• All shipping terms are governed by our Shipping Policy, including processing times (1–2 business days), delivery windows, and eligible regions.
• We are not responsible for delays caused by third-party shipping carriers, severe weather, or unforeseen events beyond our control.
• Title and risk of loss for products pass to you upon delivery to the shipping carrier.

5. Returns & Exchanges

• Our Return & Exchange Policy applies to all eligible orders. Returns must be initiated within 30 calendar days of delivery, and items must be in unused, unopened condition with original packaging.
• We provide free prepaid return labels for eligible returns. You must follow the return process outlined in our Return & Exchange Policy—do not ship items to our mailing address without prior approval.
• Refunds will be issued to your original PayPal payment method within 3–5 business days of return inspection. Exchanges are subject to product availability.

6. User Responsibilities

• You agree to provide accurate, current, and complete information when placing orders or creating an account (if available).
• You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
• You may not use our Site for any unlawful purpose, including but not limited to: submitting fraudulent orders, infringing on intellectual property rights, or transmitting malicious content.

7. Intellectual Property

• All content on our Site, including text, logos, images, product descriptions, and trademarks, is the exclusive property of Poscd or its licensors and is protected by U.S. copyright and trademark laws.
• You may not reproduce, distribute, modify, or use any content from our Site without our prior written permission.

8. Limitation of Liability

• To the fullest extent permitted by U.S. law, Poscd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Site or purchase of our products, including but not limited to lost profits or damages from delayed deliveries.
• Our total liability for any claim related to your order shall not exceed the total purchase price of the products in question.

9. Termination

• We reserve the right to terminate or suspend your access to our Site at any time, without prior notice, for any reason, including violation of these Terms or suspected fraudulent activity.
• Upon termination, your right to use our Site will cease immediately. All provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property and limitation of liability clauses.

10. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
• Any disputes arising out of or related to these Terms or your use of our Site shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

11. Changes to Terms of Service

• We may update these Terms from time to time to reflect changes in our business practices or legal requirements. We will notify you of material changes by posting the updated Terms on our Site with a new effective date.
• Your continued use of our Site after the effective date of the revised Terms constitutes your acceptance of the changes.
